The proliferation of specific advertising laws (in addition to the General Advertising Act and the Unfair Competition Act) and the existence of advertising self-regulation mechanisms require a hands-on knowledge of this matter which affects how companies communicate their goods and services.

Our services include comprehensive advice before and after the advertising communication.

We first of all have a say as to whether a specific advertising campaign may be in breach of the prevailing laws or self-regulatory standards, issuing legal reports and preventive advice.

We subsequently draw up reports, claims and, as the case may be, institute the relevant proceedings to put an end to unlawful situations or enforce our clients’ interests.

We act with respect to the Spanish ADVERTISING STANDARDS ASSOCIATION and the Courts of Justice.

UNFAIR COMPETITION

Although unfair practices are usually very closely linked in the sector of the industrial property to the violation of exclusive rights, it is increasingly frequent to come across so-called unfair practices, especially following the amendment to the Unfair Competition Act which also makes provision for practices affecting consumers.

Likewise, new technologies have created new scenarios in which market rules are breached and which are usually covered by unfair competition.
